In consideration of the right to hunt through Know Where To Hunt, I hereby release and discharge Know Where To Hunt, the owner of Know Where To Hunt and any owners of properties that Know Where To Hunt leases, and any agent, employee or volunteer acting on behalf of any of the foregoing (collectively called the “Releasees”) on behalf of myself, my spouse, my children and our heirs, successors, assigns, personal representatives, and estate, and I individually, and on their behalf agree as follows:
I acknowledge and understand that activities involving hunting, including but not limited to use of firearms and/or the use of all-terrain vehicles (collectively the “Activities”) involve known and unanticipated risks which could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I agree to wear appropriate safety gear. I have sufficient experience with hunting to understand the risk of being involved in this kind of Activity, including lack of visibility, difficult terrain with water present and risks from other hunters. I HEREBY EXPRESSLY ACCEPT AND ASSUME FULL RESPONSIBILITY FOR ALL OF THE RISK EXISTING IN THE ACTIVITIES HEREIN DESCRIBED AND I ELECT TO PARTICIPATE IN SPITE OF THE RISKS. I acknowledge that participation waterfowl hunting may require a degree of skill, knowledge, experience and protective gear. I possess, or acknowledge that I have the responsibility to obtain, that skill, knowledge, experience and protective gear necessary to safely participate in the Activity. I also agree that I have all the necessary WA State hunting licenses to legally hunt waterfowl and agree to obey the KWTH rules.

AS CONSIDERATION FOR BEING PERMITTED ACCESS AND UTILIZE THE PREMISES UPON WHICH HUNTING ACTIVITIES WILL BE CARRIED OUT AND PARTICIPATE IN ONE OR MORE OF THE ACTIVITIES, I HEREBY AGREE THAT I, MY SPOUSE, MY CHILDREN AND OUR RESPECTIVE ASSIGNEES, HEIRS, SUCCESSORS IN INTEREST, GUARDIANS, AND LEGAL REPRESENTATIVES WILL NOT MAKE A CLAIM AGAINST OR SUE THE RELEASEES (INCLUDING THROUGHOUT THIS PARAGRAPH AND THIS AGREEMENT THOSE IDENTIFIED IN THE INTRODUCTORY PARAGRAPH ABOVE AND ON THE SIGNATURE PAGE) FOR INJURY, DEATH, OR PROPERTY DAMAGE RESULTING FROM THE NEGLIGENCE OR OTHER ACTS OR OMISSIONS OF THE RELEASEES, OR ANY OF THEM, HOWSOEVER CAUSED, AS A RESULT OF MY ACCESS TO OR USE OF THE PREMISES OR PARTICIPATION IN ANY OF THE ACTIVITIES AND I HEREBY RELEASE THE RELEASEES AND EACH OF THEM, FROM ALL ACTIONS, CLAIMS, OR DEMANDS THAT I, MY SPOUSE, MY CHILDREN AND OUR RESPECTIVE ASSIGNEES, HEIRS, SUCCESSORS IN INTEREST, GUARDIANS, AND LEGAL REPRESENTATIVE NOW HAVE OR MAY HEREAFTER HAVE, KNOWN OR UNKNOWN, FOR INJURY DEATH, OR PAGE PROPERTY DAMAGE RESULTING FROM ACCESS TO OR USE OF THE PREMISES OR PARTICIPATION IN ANY OF THE ACTIVITIES, AND I VERIFY THIS STATEMENT BY VOLUNTARILY PLACING MY INITIALS HERE:

By signing this agreement, I acknowledge that if anyone is hurt or if property is damaged during my use of the Premises and/or participation in any of the Activities, I may be found by a court of law to have waived my right to maintain a lawsuit against the Releasees on the basis of any claim from which I have released the Releases herein.

1. Attorneys Fees. Should the Releasees or anyone acting on the releases behalf be required to incur attorneys’ fees and costs to enforce this agreement, I agree to indemnify and hold the Releases harmless from all such fees and costs.

2. Insurance, Indemnity & Physical Condition. I have adequate insurance to cover any injury or damage that I may cause or suffer while utilizing the Premises or participate in the Activities, or else I agree to bear the costs of such injury or damage to myself. I hereby agree to indemnify and defend the Releasees and each of them from the results of any actions I may take on the Premises and/or arising out of my participation in any of the Activities. I have no medical or physical condition which could interfere with my safety in utilizing the Premises or participation in the Activities, or else I am willing to assume and bear the costs of all risks that may be created, either directly or indirectly, by any such condition.

3. No Warranty. I acknowledge that no claim or warranty is given by the Releasees as to the quality, condition or safety of the Premises or of any services provided. No warranty is given or implied by the Releasees that the Premises are in fact safe to use, in good working order or that its use is appropriate for my need.

4. Term. The term of this agreement shall be valid for the waterfowl season specified in the Agreement only and shall be terminated automatically without notice at the end of said term. 8. Refusal of Access. Notwithstanding the foregoing, the Releasees, or any of them, may refuse access to or the right to utilize the Premises or participate in any activity to any person at any time. If any portion of this Agreement is determined to be unenforceable, the remaining portions shall remain in full force and effect. The paragraph headings are for ease of reference only and shall not limit the interpretation or control the meaning of any paragraph. I have had sufficient opportunity to read this entire Agreement. I have carefully read and understand it, and agree to be bound by its term
